Brewmart Loyalty Card Terms and Conditions

1. General
These Terms & Conditions are applicable when you apply for, are in the possession of and/or use the Brewmart loyalty card, hereafter 'loyalty card'. The holder of the loyalty card, hereafter 'loyalty member', has taken notice of these Terms & Conditions by filling out the application form. By filling out the application form, the loyalty member has agreed these Terms & Conditions.

2. Apply for the loyalty card
All natural persons of 18 years and older can apply for a loyalty card by signing an application form and submitting this form in one of our shops. Your application will be judged by Brewmart Pty Ltd and can be refused without reason. You can only apply for one loyalty card per person. The loyalty card may only be used by one individual. After acceptance the loyalty card (price R80.00) is ready to use.

3. Points and Discount
The loyalty card gives you the possibility, but no obligation, to earn points each time a product is purchased in a physical store from Brewmart Pty Ltd. The points are limited to in-store use only and can't be earned or spent through the online shopping portal at www.brewmart.co.za. For each rand spent, one point is earned. 100 points earned on the card equals 1 Rand. The maximum value that can be accumilated on the card is 200 Rand.You must show your physical loyalty card before paying at the cash desk to earn points. Loyalty points can only be earned for card purchases. No images or copies of the card will be accepted. After finalizing the payment it is not possible to earn points. Brewmart Pty Ltd is allowed to make special arrangements during specified periods in which the loyalty member can get additional points or discounts on specified products. The value on the card is exchangeable for services in the store and may not be refunded or redeemed for cash. No cash change will be given. This card is redeemable in participating stores only subject to Brewmart's discretion. Additional value can be added to this card subject to Brewmart's discretion. 5. Losing the loyalty card
It is possible for a loyalty member to apply for a new loyalty card when your loyalty card is lost or damaged. Brewmart Pty Ltd will charge R80.00 exl VAT administration costs when the new loyalty card is picked up. After checking the information the lost loyalty card will be blocked. We can transfer your granted discount of the lost loyalty card to the new loyalty card.

6. Ownership and use of the loyalty card
The loyalty card will remain property of Brewmart Pty Ltd. The loyalty card is strictly non-transferable and can only be used by private persons. The loyalty member may not lend out his card. Brewmart Pty Ltd will directly block the loyalty card when unlawful use is ascertained. All points granted and given to the loyalty member will be charged back. Brewmart Pty Ltd can block and take back the loyalty card without prior consent and without reason. The granted points will then expire automatically. When the loyalty member does not want to use the loyalty card anymore, he should return his card to Brewmart Pty Ltd.

7. Changes and termination
Brewmart Pty Ltd has the right to change and/or cancel the benefits (such as the points) of the loyalty card. Brewmart Pty Ltd also has the right to change or cancel the whole loyalty program. In case each of these cases occur Brewmart Pty Ltd will communicate this in its store, on the website and/or per e-mail and/or sms. This card is valid for 36 months from the most resent date of when money was last loaded on this card.

8. Privacy and personal data
The data of the loyalty member and itís purchases will be registered in a Brewmart Pty Ltd data file and will be handled confidential. Brewmart Pty Ltd is entitled to use this data to inform loyalty members about (additional) benefits, to send mailings and for analysing purposes. By using this card you acknowledge that Brewmart Pty Ltd may share your contact details and information provided with the relevant technology partners. Changes in the personal data of the loyalty member should be reported to one of the shops. By using this card the loyalty member agrees to receive email, sms and newsletters.

9. Liability
Brewmart Pty Ltd is not responsible for any liability due to loss or theft of the loyalty card, neither due to unauthorized use and/or fraudulent actions with the loyalty card. Exempted from cases of deliberate action or gross negligence, Brewmart Pty Ltd is not liable for any loss in relation to or due to not being able to use, not being able to use in time and/or not fully able to use the loyalty card, for whatever reason. Besides, Brewmart Pty Ltd is not liable for any loss arising from the use and the trust in the information about the benefits of the loyalty card. In case of any presumption of fraud, misuse or misguided behaviour Brewmart Pty Ltd has the right to cancel the benefits of the loyalty card and to terminate the loyalty card.

10. Final provisions
Brewmart Pty Ltd reserves the right, at our sole discretion, to update, change or replace any part of these Terms & Conditions without notification to the loyalty member. The updated Terms & Conditions are available at www.brewmart.co.za . The continued use of the loyalty card by the loyalty member after the moment changes are made constitutes acceptance of those changes. In the event that any provision of these Terms & Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms & Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.
